What Is The Warranty Offered By Giatex?

RideTHISbike.com is an authorized reseller of Giatex Bicycles, Inc. As such, the Giatex Bicycles, Inc. warranty applies to all bicycles sold through us. Following are the complete warranty details as found at giatexbikes.com; this info is current as of 15 July 2005.

Giatex Bicycles Inc. warrants your bicycle frame set including forks against defects in workmanship and materials for one (1) year and for one (1) year on all remaining parts (excluding tires, tubes, cables and chains) for all bicycles sold through Giatex Bicycles Inc. and its authorized agents and dealers. This warranty is not transferable and is only valid for the original purchaser. The original owner must pay all applicable labor and transportation charges connected with any repair or warranty work and proof of purchase is required for all warranty repairs. This warranty is valid only for your Giatex stretching bicycle. There are no other expressed warranties.

The obligation of Giatex Bicycles Inc. is expressly limited to the correction of the defect by adjustment, repair or replacement, solely at the discretion of Giatex Bicycles Inc. This warranty does not cover paint or other finishes as well as decals. The warranty does not cover normal wear and tear or normal maintenance items or damage or failure caused by improper assembly or maintenance, improper stretching or compressing, neglect, being ridden by more than one person at a time, installation of a motor or of parts or accessories not originally intended or compatible with the bicycle as sold or altered or modified from the original manufacturer's specifications.

The warranty does not cover damage or failure caused by the use of the bicycle for stunt riding, ramp jumping, dirt jumping, acrobatic tricks or similar or any other abnormal activities, alterations, collision, crash or misuse. The bicycle has not been designed, engineered, distributed, manufactured, or retailed for use in trick riding, ramp riding, jumping, aggressive ridings, riding on severe terrain, riding in severe climates, riding with heavy loads, commercial activities, or any similar activities; such uses may damage the bicycle, and can cause serious injury to the rider, and in all cases will void this warranty. Bent handlebar, forks, frame, wheels or seat posts are signs of misuse or abuse. The bicycle is designed for general transportation and recreational use only. This warranty does not cover use as a rental vehicle or commercial use vehicle.

No representation or other affirmation of fact, including but limited to, statements regarding capacity, suitability for use or performance of the bicycle, shall be deemed to be a warranty or representation by Giatex Bicycles Inc. for any purpose, nor give rise to any liability or obligation on the part of Giatex Bicycles Inc. Except as specifically provided in this agreement, there are no other warranties expressed or implied, including but not limited to, any implied warranties of merchantability or fitness for a particular purpose, and in no event shall Giatex Bicycles Inc. be liable for loss of profits or benefits indirect, incidental, special, consequential or other similar damages arising out of any breach of this warranty or otherwise. This warranty shall not be applicable to the extent that any of its provisions are prohibited by any jurisdictions, which cannot be preempted. This warranty gives you specific legal rights, and you may have other rights, which vary from place to place.
